1. Introduction and Acceptance of Terms

Welcome to Rentals Depot. These Terms of Service (“Terms”) govern your access to and use of the Website, including all content, features, listings, booking tools, and services made available through it (collectively, the “Services”).

By accessing the Website, browsing listings, creating an account, submitting an inquiry, or making a reservation, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree with any part of these Terms, you must not access or use the Services.

You must be at least 18 years of age and legally capable of entering into a binding contract to use the Services. By using the Website you represent and warrant that you meet these requirements.

2. Definitions

“Guest” means any individual who books, reserves, or stays at a Property listed on the Website.
“Property” means any rental unit, residence, or accommodation listed for short-term rental on the Website.
“Booking” means a confirmed reservation of a Property for specified dates.
“Content” means any text, images, photos, video, reviews, or other material published on or submitted through the Website.
“User” means any person who accesses or uses the Website, including Guests and general visitors.

3. About Our Services

Rentals Depot operates an online platform that lists short-term rental Properties located in the United States and enables Users to browse listings, check availability, and submit booking requests. Some Properties may be owned directly by Rentals Depot; others may be managed on behalf of third-party owners.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice, without liability to you.

4. User Accounts

Certain features of the Website may require you to create an account. You agree to:

Provide accurate, current, and complete information during registration and keep it updated;
Maintain the confidentiality of your login credentials;
Be responsible for all activity that occurs under your account;
Notify us immediately of any unauthorized use of your account at Contact

We reserve the right to suspend or terminate any account that we believe, in our sole discretion, has violated these Terms or engaged in fraudulent, abusive, or unlawful activity.

5. Bookings and Reservations

5.1 Booking Process

When you submit a Booking through the Website, you are making an offer to reserve the selected Property for the specified dates. A Booking is not confirmed until you receive a written confirmation from Rentals Depot and full payment (or the required deposit) has been processed.

5.2 Accuracy of Listings

We make reasonable efforts to ensure Property descriptions, photos, pricing, and availability are accurate. However, we do not warrant that listings are free from errors or omissions. Prices, availability, and Property details are subject to change at any time prior to booking confirmation.

5.3 Minimum and Maximum Stays

Each Property may have minimum- and maximum-stay requirements, occupancy limits, and other rules as shown on its listing page. You agree to comply with all listed restrictions.

5.4 Check-in and Check-out

Standard check-in and check-out times are specified on each Property listing. Early check-in or late check-out must be arranged in advance and is not guaranteed.

6. Pricing, Payment, and Taxes

6.1 Pricing

All prices are shown in U.S. dollars and are per night unless stated otherwise. Displayed prices may not include cleaning fees, service fees, security deposits, occupancy taxes, or other applicable charges, which will be disclosed before you complete your Booking.

6.2 Payment

Payment is processed through third-party payment processors. By submitting payment information, you authorize Rentals Depot and its processors to charge the applicable amounts to your chosen payment method. You represent that you are authorized to use the payment method provided.

6.3 Security Deposits

Certain Properties may require a refundable security deposit. Deposits will be returned within 14 days following check-out, less any deductions for damages, excessive cleaning, unpaid charges, or violations of the Property rules.

6.4 Taxes

Where applicable, transient occupancy taxes, sales taxes, tourism taxes, and other government-imposed fees will be added to your total.

7. Cancellation and Refund Policy

7.1 Guest Cancellations

Cancellations made more than 30 days before the check-in date: full refund less a processing fee.
Cancellations made between 7 and 5 days before check-in: 50% refund.
Cancellations made less than 2 days before check-in: no refund.
No-shows: no refund.

7.2 Cancellations by Rentals Depot

In rare cases, we may need to cancel a Booking due to circumstances beyond our reasonable control (property damage, unavailability, force majeure, safety concerns, or fraudulent bookings). In such cases, we will either relocate you to a comparable Property (subject to availability) or issue a full refund of amounts paid. This remedy is your sole and exclusive remedy for such cancellations.

7.3 Changes to Bookings

Modification requests (dates, guest count, duration) are subject to availability and may result in price adjustments.

8. Guest Conduct and Property Rules

By staying at a Property, you and all members of your party agree to:

Use the Property only for lawful residential lodging purposes;
Not exceed the maximum occupancy listed for the Property;
Not host parties, events, or commercial activities without prior written consent;
Comply with all applicable laws, ordinances, HOA rules, and Property-specific house rules;
Not smoke inside the Property unless expressly permitted;
Not bring pets unless the Property is pet-friendly and you have obtained written approval;
Respect neighbors, quiet hours, and noise ordinances;
Not damage, alter, or remove any part of the Property or its contents;
Promptly report any damage, malfunction, or safety concern.

You are financially responsible for any damage caused by you or your guests. We reserve the right to terminate any stay without refund for material violations of these rules.

9. Assumption of Risk

You acknowledge that staying in a rental property involves inherent risks, including but not limited to slips, falls, pool or hot tub use, use of appliances and equipment, and conditions of the surrounding neighborhood. You accept these risks voluntarily on behalf of yourself and all members of your party.

10. Intellectual Property

All Content on the Website — including logos, trademarks, text, graphics, photographs, listing descriptions, and software — is the property of Rentals Depot or its licensors and is protected by U.S. and international intellectual property laws.

You may not copy, reproduce, modify, distribute, scrape, frame, or create derivative works from any Content without our prior written consent, except that you may view, save, and print pages for your personal, non-commercial use in connection with a Booking.

11. User-Submitted Content

If you submit reviews, comments, photos, or other Content to the Website, you grant Rentals Depot a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, and display such Content in any media.

You represent and warrant that: (a) you own or have the necessary rights to the Content you submit; (b) the Content does not violate any law or third-party rights; and (c) the Content is not false, defamatory, obscene, threatening, or otherwise objectionable.

We reserve the right (but have no obligation) to review, edit, or remove any User-submitted Content at our sole discretion.

12. Prohibited Uses

You agree not to:

Use the Website for any unlawful purpose or in violation of these Terms;
Impersonate any person or entity or misrepresent your affiliation;
Submit false, misleading, or fraudulent information, including payment information;
Attempt to gain unauthorized access to any portion of the Website, servers, or accounts;
Introduce viruses, malware, or other harmful code;
Scrape, harvest, or otherwise collect data from the Website via automated means;
Interfere with or disrupt the operation of the Website;
Use the Website to harass, threaten, or abuse any person.

THE WEBSITE AND ALL SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, RENTALS DEPOT DOES NOT WARRANT THAT:

The Website will be uninterrupted, secure, or error-free;
Any Content, including listings, is accurate, complete, or current;
Any Property will meet your expectations;
Defects or errors will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RENTALS DEPOT LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR ANY PROPERTY, WHETHER BASED ON CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO RENTALS DEPOT IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (US$100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some of the above limitations may not apply to you.

16. Indemnification

You agree to indemnify, defend, and hold harmless Rentals Depot LLC and its officers, directors, employees, agents, and affiliates from and against any claims, demands, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Website; (b) your violation of these Terms; (c) your violation of any third-party right; (d) any damage you or your party cause to a Property; or (e) any Content you submit.

17. Termination

We may suspend or terminate your access to the Website or any Services at any time, without notice, for any reason, including suspected violation of these Terms. Upon termination, provisions that by their nature should survive (including Sections 10, 14, 15, 16, 18, and 19) will continue to apply.

18. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith informal negotiation. If unresolved after thirty (30) days, the dispute shall be Commercial Arbitration Rules, with arbitration to occur in Temecula, Ca; OR (b) submitted to the exclusive jurisdiction of the state and federal courts located in Temecula,Ca.

Class Action Waiver (if using arbitration): To the extent permitted by law, you and Rentals Depot agree that any dispute will be resolved only on an individual basis and not as part of any class, consolidated, or representative action.

19. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date at the top will reflect the most recent version. Material changes will be communicated by posting a notice on the Website or by email where we have your address on file. Your continued use of the Website after changes take effect constitutes acceptance of the revised Terms.

20. Miscellaneous

Entire Agreement: These Terms, together with the Privacy Policy and any Booking confirmation, constitute the entire agreement between you and Rentals Depot regarding the Services.
Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
No Waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment: You may not assign these Terms without our written consent. We may assign these Terms freely.
Force Majeure: Neither party is liable for failure to perform due to causes beyond its reasonable control, including natural disasters, acts of war, terrorism, pandemics, government actions, or utility failures.
Headings: Section headings are for convenience only and do not affect interpretation.
